Interactive Process Facilitation

The Interactive Process is a legally required, good-faith dialogue between an employer and an employee to determine whether a reasonable accommodation can be provided for a disability. When conducted improperly, the Interactive Process can expose employers to significant legal risk.

What Is the Interactive Process?

In plain terms, the Interactive Process involves:

  • Communicating with the employee about limitations and job duties
  • Reviewing medical documentation, when applicable
  • Exploring potential reasonable accommodations
  • Determining whether an accommodation creates an undue hardship
  • Documenting decisions and outcomes
